Terms and conditions for purchases from our online store

In these Sale Terms & Conditions (Sale Terms), “we” or “us” means The Montessori Australia Group trading as Montessori Australia, its successors and assignees. “You” means the person, organisation or entity that purchases products or related services from us.

The Sale Terms apply to all sales made by us to consumers through our website, which is available at www.montessori.org.au (Site).

Important: Your purchase from us indicates that you have had sufficient opportunity to access the Sale Terms and contact us, that you have read, accepted and will comply with the Sale Terms, and that you are eighteen (18) years or older. You must not order products or services from us if you are under eighteen (18) years of age.

Registration

  • We will confirm your account registration when you register on our Site. It is your responsibility to keep your account details confidential.
  • You are liable for all activity on your account, including purchases made using your account details.

Orders

You may order from us as set out on the site. We may, at our discretion, accept or reject an order depending on factors such as product availability and our ability to validate payment for the products.

It is your responsibility to check the order details, including product and pricing, before you complete your order on our Site.

We will provide you with an order number containing the order ID, the shipping and billing addresses and a description of what was ordered when you order and pay on our site and your payment has been validated.

A binding agreement comes into existence between you and us once we have given you an order number. No changes to the Sale Terms will be effective unless we both agree to the changes in writing.

You can cancel your order by contacting us by phone at any time before the product is dispatched. If the product has already been shipped, please refer to our Refund Policy below.

For some products, there may be the option of a gift card and/or gift-wrapping service. If you wish to attach a gift card or request our gift-wrapping services, please follow the prompts at the checkout stage. Some larger-sized products cannot be gift-wrapped. Our gift wrap is gender neutral. A separate charge for gift-wrapping services will be added at the checkout stage if you select this option.

Payments

You agree to pay the purchase price specified at the checkout stage when you place your order for a product, plus any applicable delivery and insurance charges based on the delivery options you select. All amounts are stated in Australian dollars. All purchase prices shown on the Site are inclusive of GST. The GST amount payable will be visible at the checkout stage.

Unless you are a provider organisation, you must pay for the product by credit card. Your payment will be processed upon receipt of your order. You must not pay or attempt to pay for an order through any fraudulent or unlawful means. If your payment is not successfully processed, your order may be cancelled.

Provider organisations can choose to select payment by Invoice, which needs to be paid by direct deposit prior to the dispatch of your order.

Availability and Cancellation

All purchases made with us are subject to availability. We do our best to keep most of the products we advertise in stock and to keep our Site up to date with product availability.

If there is a considerable delay in dispatching your order, or if for any reason, we cannot supply a product you ordered, we will contact you using the contact details you provided when you placed the order. You can choose a refund, store credit, or put your order on backorder as you agreed.

If you choose a refund or store credit, any delivery costs you have paid for the product will be refunded to you. If you choose to put your order on backorder, we will contact you to arrange for delivery once the product is available.

Delivery

Location

We deliver Australia-wide. At this stage, we do not deliver to places outside of Australia or New Zealand. Please refer to the delivery information on our site to ensure that you are in our delivery area. If you are not in our delivery area, please contact us to discuss delivery options.

Cost

Approximate shipping rates (at time of publication):

  • Orders <$300 – $16
  • Orders $300-$500 – $24
  • Orders >$500 and above – $39

Shipping prices are for urban and some semi-rural areas. Based on your postcode, additional shipping charges may apply for rural and remote areas.

Timing

We will normally dispatch the product within 24 hours of receiving your order unless otherwise noted on the Site. Any delivery periods displayed on the Site are estimates only, based on the information provided by the delivery company. We will deliver the product to the place of delivery you specify when making your order.

Change

If you need to change a delivery date or address, please contact us as soon as possible to see if this is possible. If you are not available to take delivery on the agreed-upon delivery date, you may be charged a delivery fee for each additional attempt.

Method

We may deliver the products via various methods. The delivery instructions are for the driver to leave the package in a suitable location if there is no one available to sign for a delivery. Alternatively, you may be notified, generally by the delivery company, leaving a card with contact details so that you can arrange another delivery time and date. If you do not want the delivery package left unattended, or if you wish to have the package insured, you can let us know during the checkout. Additional delivery charges may apply.

Title

Title in the products will not pass to you until the later of delivery or when we have processed or otherwise received your payment. If your payment is declined for any reason, we reserve the right to reclaim the products from your possession, custody, or control, even if they have been delivered to you or moved from the delivery address. We reserve the right to keep or sell the products. Risk of loss, damage, or deterioration to any products will pass to you on delivery.

Discount Codes and Promotions

We may offer promotional discount codes from time to time. These codes may apply to goods on the Site and must be entered when submitting your order. The conditions of use relating to any discount code will be specified when it is issued.

Consumer Guarantees

Seller’s goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in the Sale Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the ACL or any liability under the ACL, which by law may not be limited or excluded.

Consumer Notice: “Our goods come with warranties and guarantees that cannot be excluded under the Australian Consumer Law (Consumer Guarantees). You are entitled to a replacement or a refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.”

Your product may come with a manufacturer’s warranty. The manufacturer’s warranty is in addition to but may overlap with any rights and remedies you may have under applicable law, including any Consumer Guarantees. If you are not considered a “consumer” within the meaning of the ACL, the manufacturer’s warranty may be your sole remedy. You should check the manufacturer’s warranty, as many manufacturers’ warranties do not apply in a business or commercial setting. Please contact the manufacturer if you would like to make a claim under the manufacturer’s warranty.

Returns and Refunds Policy

14-Day Return Policy: If you are not happy with your purchase for any reason, you can return it to us within 14 days of the purchase date for a full refund, exchange, or credit note of the purchase price. However, there will be no refund for postage costs.

Important conditions:

  • You are responsible for the postage costs of returning the items to us.
  • We will only give you the refund, exchange, or credit note once we receive the product and inspect it at our warehouse.
  • Please allow up to ten (10) Business Days for your return and refund request to be processed.
  • Returned items must be received in original, unopened condition and packaged such that transit damage does not occur.
  • We will not accept for return any product that has been used, connected, installed, attempted to be connected or installed, or if your product is a sale or clearance item, custom-made, or is a special buy product (other than as required under the Australian Consumer Law).
  • You have a duty of care for the product while it is in your possession. If you damage products and then subsequently return them, you may be liable to pay to repair them to their original condition.
